Após o presidente do Senado, Rodrigo Pacheco (PSD-MG), apresentar uma PEC (proposta de emenda à Constituição) para criminalizar qualquer porte ou posse de droga, os senadores avaliam mais duas medidas contra temas pautados no STF (Supremo Tribunal Federal): os impostos sindicais e o aborto.
A visão entre líderes do Senado ouvidos pela reportagem é a de que o Supremo tem invadido a competência do Congresso de legislar. E a forma de reagir a isso é alterando o texto da Constituição.
Neste sentido, a primeira reação foi a PEC, apresentada por Pacheco na última quinta-feira (14), para criminalizar a posse e o porte de drogas, independentemente da quantidade ou da substância.
A medida foi protocolada menos de um mês após o Supremo retomar o julgamento da descriminalização do porte de drogas para uso pessoal a partir da interpretação de um artigo da lei 11.343/2006, a chamada Lei de Drogas. O placar está em 5 a 1 a favor da descriminalização.
"A lei considerará crime a posse e o porte, independentemente da quantidade, de entorpecentes e drogas afins sem autorização ou em desacordo com determinação legal ou regulamentar", diz o texto proposto por Pacheco, que já escreveu artigo para defender que o STF não tem competência para tratar do tema.
O trecho seria acrescido na forma de inciso ao artigo 5º da Constituição.
Senadores e deputados federais protestam contra o julgamento com o argumento de que a medida deveria ser discutida pelo Congresso, não pelo STF. No início do mês passado, Pacheco disse que as "discussões políticas" deveriam ocorrer em âmbito político.
Outro julgamento que causou incômodo no Senado foi o do imposto sindical.
Na última segunda (11), o STF definiu que os sindicatos poderão cobrar contribuição assistencial de todos os trabalhadores representados por eles, sejam sindicalizados ou não.
Segundo a tese, aprovada por maioria de votos, é permitida a cobrança da contribuição, desde que o trabalhador não sindicalizado tenha o direito de se opor a ela.
O terceiro tema, que ainda não foi tema de decisão do STF, é o aborto.
Na última terça (12), a presidente do Supremo, ministra Rosa Weber, liberou para julgamento a ação que trata da descriminalização do aborto durante o primeiro trimestre de gestação ela é a relatora.
A ADPF (Arguição de Descumprimento de Preceito Fundamental) 442, apresentada pelo PSOL em 2017, ainda não tem data para ser julgada.
A ação questiona a violação de direitos fundamentais das mulheres diante da manutenção do atual entendimento no país sobre aborto. A lei brasileira criminaliza o aborto com apenas três exceções: risco de vida, gravidez resultante de estupro e feto anencéfalo.
Também pede que sejam excluídas a incidência de artigos do Código Penal sobre a interrupção induzida e voluntária da gestação nas primeiras 12 semanas.
Na visão de senadores, esse tipo de assunto é legislativo e, portanto, deveria ser tratado pelo Congresso.
Os três temas vêm sendo discutido pelas lideranças nos corredores e também nas reuniões semanais, que definem as pautas que serão votadas pelo Senado.
Foi em um desses encontros, na semana passada, em que foi batido o martelo sobre a PEC antidrogas, que acabou anunciada por Pacheco logo após o fim da reunião.
Segundo presentes, a Casa ainda estuda como se posicionar diante dos outros dois assuntos.
Especificamente acerca do aborto, a tendência, na visão dos parlamentares, é que a PEC seja mais conservadora que a decisão do STF, em razão da composição do colégio de líderes —a reunião costuma ser amplamente composta por homens.
"Esses temas são muito caros aqui e a tendência é fazer algo parecido [com o caso das drogas]", afirmou Izalci Lucas (PSDB-DF). "Não tenho dúvidas de que a questão do imposto e do aborto, a depender do que o Supremo definir, serão questionadas."
Ele afirma que o debate no Legislativo, além de estar previsto na divisão de competência dos Poderes, também dá mais segurança jurídica às decisões sobre esses temas.
"Então a gente precisa restabelecer essa segurança [jurídica], com os limites de cada Poder, e para isso temos a Constituição, e cabe ao Supremo cuidar dela", afirma.
