A recuperação de débitos inscritos na Dívida Ativa da União (DAU) deve reforçar o caixa do governo em R$ 46 bilhões no próximo ano, divulgou a Procuradoria-Geral da Fazenda Nacional (PGFN). O valor já está incorporado à estimativa de receita de R$ 2,7 trilhões prevista no projeto de lei do Orçamento Geral da União de 2024, encaminhado ao Congresso no fim de agosto.
A Dívida Ativa da União representa os débitos de contribuintes que deixaram de ser cobrados administrativamente pela Receita Federal e passaram a ser executados na Justiça pela PGFN. Dos R$ 46 bilhões previstos para serem recuperados, R$ 12 bilhões virão do novo mecanismo de transação tributária em contenciosos, inserido na nova lei que reformulou o sistema de votação do Conselho Administrativo de Recursos Fiscais (Carf).
Criada em 2020 para ajudar empresas afetadas pela pandemia da covid-19, a transação tributária permite que o contribuinte renegocie débitos – tanto com a Receita Federal como com a PGFN – com descontos nos juros e nas multas. A adesão ao programa, no entanto, depende do pagamento de uma entrada e da análise da capacidade de pagamento do devedor, com o governo propondo um plano de pagamento das parcelas. A lei do novo Carf concedeu mais incentivos para tornar esse tipo de mecanismo mais atrativo aos contribuintes.
Além dos R$ 12 bilhões de débitos inscritos em dívida ativa, o projeto do Orçamento de 2024 prevê a recuperação de R$ 30,1 bilhões em dívidas com a Receita Federal. O governo conta com o dinheiro para aumentar as receitas em R$ 168 bilhões e tentar zerar o déficit primário no próximo ano, como estabelecido no novo arcabouço fiscal.
Segundo a PGFN, a transação tributária está se consolidando como um dos principais instrumentos de recuperação de recursos pelo governo. Para este ano, o órgão tinha estimado em R$ 30 bilhões a receita com a recuperação de débitos inscritos na Dívida Ativa da União. No fim do primeiro semestre, o órgão tinha recuperado R$ 21,9 bilhões, dos quais R$ 10 bilhões vieram de acordos de transação tributária.
Novos incentivos
Inserida na lei do novo Carf, a transação no contencioso permite ao contribuinte negociar débitos ainda em discussão administrativa ou judicial. Segundo a PGFN, esse mecanismo tem três vantagens: contribui para a redução do litígio no Carf e no Judiciário; aumenta a disponibilidade de recursos no caixa das empresas; e recompõe a arrecadação do governo.
A PGFN estuda oferecer editais para regularizar, por meio de acordos consensuais, débitos relacionados a teses jurídicas sobre a base de cálculo do Programa de Integração Social (PIS) e da Contribuição para o Financiamento da Seguridade Social (Cofins). Em estudo preliminar, a procuradoria estimou que existem pelo menos 19 teses jurídicas de PIS/Cofins com valor em discussão da ordem de R$ 800 bilhões.
